These Terms of Service ("Terms") govern your use of the Simply Gift website at www.simplygift.co.uk and the Simply Gift application (together, the "Service"), provided by Simply Gift Ltd ("Simply Gift", "we", "us", or "our"), a company registered in England and Wales.
These Terms are governed by the laws of England and Wales. If you are a consumer, you may also have rights under applicable consumer protection legislation including the Consumer Rights Act 2015.
To use Simply Gift you must be at least 13 years old. By creating an account, you confirm that you meet this requirement. If you are under 18, you confirm that a parent or guardian has consented to your use of the Service.
Simply Gift is intended for personal, non-commercial use. Use of the Service for commercial purposes (for example, operating a gift-giving business) requires our prior written consent.
When you create an account, you must provide accurate and complete information. You are responsible for keeping your login credentials secure and for all activity that occurs under your account.
You must notify us immediately at hello@simplygift.co.uk if you suspect unauthorised access to your account.
You may only create one account per person. We reserve the right to suspend or close duplicate accounts.

We provide the Service on a free-to-use basis. We may introduce paid features in the future; if we do, we will make this clear and any charges will be opt-in.
Our price comparison feature searches publicly available prices from third-party retailers. We do not guarantee the accuracy, completeness, or availability of price data. Prices shown are for reference only — always verify the price on the retailer's website before purchasing. Simply Gift is not a party to any purchase transaction you make with a retailer.
Simply Gift facilitates the coordination of group gifts by tracking contributions. We do not process or hold payments. Any financial arrangements between group members are entirely between those members. We are not responsible for any disputes arising from group gifting arrangements.
You agree to use Simply Gift only for lawful purposes and in a way that does not infringe the rights of others. You must not:
We reserve the right to suspend or terminate accounts that we reasonably believe are in breach of these rules.
You retain ownership of any content you create using Simply Gift (gift lists, recipient names, product descriptions, messages, etc.). By submitting content to the Service, you grant us a limited, non-exclusive licence to store and display that content solely for the purpose of providing the Service to you.
You are responsible for ensuring that any content you submit does not infringe the rights of third parties. You must not upload or share content that you do not have the right to use.
All intellectual property rights in the Simply Gift website, application, design, software, and branding belong to Simply Gift Ltd or our licensors. Nothing in these Terms transfers any of those rights to you.
You may use the Service for its intended personal purpose. You may not copy, reproduce, distribute, or create derivative works from any part of the Service without our express written permission.
Simply Gift may display links to third-party retailers and websites. We have no control over those websites and are not responsible for their content, privacy practices, or availability. Clicking a link to a third-party site is at your own risk.
We aim to keep Simply Gift available at all times but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, technical issues, or circumstances beyond our control.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time. Where possible, we will give reasonable notice of material changes.
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not warrant that the Service will be error-free, uninterrupted, or free of viruses.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.
To the fullest extent permitted by applicable law, Simply Gift Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, loss of profits, or loss of goodwill.
Our total aggregate liability to you in respect of any claim arising under or in connection with these Terms shall not exceed £100 or the total amount you have paid to us in the 12 months preceding the claim, whichever is greater.
If you are a consumer, these limitations do not affect your statutory rights.
You may delete your account at any time from within the Service or by contacting us at hello@simplygift.co.uk. Upon deletion, your personal data will be removed in accordance with our Privacy Policy.
We may suspend or terminate your account if you breach these Terms, if we are required to do so by law, or if we discontinue the Service. We will give you reasonable notice where possible, except where we are required to act immediately (for example, for security reasons).
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and notify you by email where appropriate. Continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.
These Terms are governed by the law of England and Wales. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales, except that if you are a consumer resident in Scotland or Northern Ireland, you may bring proceedings in the courts of your country of residence.
